Waiver of Liability and Hold Harmless Agreement

1. In consideration for receiving permission to participate in these Private Tutoring sessions, you hereby release, waive, discharge and covenant not to sue Enlightening Learners , Paul Bretz, his associates, affiliates, and/or the facility where this activity is held (hereinafter referred to as releasees) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or any of the property belonging to you, whether caused by the negligence of the releasees or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.
2. You further hereby agree to indemnify and hold harmless the releasees from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to your participation in said activity, whether caused by the negligence of releasees or otherwise.
3. It is your express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representative, if you are deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named releasees. You hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of California.
4. You warrant and assure that you are at least 18 years of age and fully competent. You acknowledge that the above constitutes the whole of our waiver of liability and hold harmless agreement, and that no additional claims or representations have been made.
While we endeavor to provide the best tutoring services possible, we do not guarantee improved grades or performance in school.

Private Tutoring Satisfaction Guarantee

After attending your first Private Tutoring session, if you are not satisfied for any reason, you may cancel your remaining tutoring sessions and receive a refund for those sessions not yet attended. Should you choose to cancel a prepaid Tutoring Package after attending your first session, the hours which you have attended will be billed/deducted at our current Hourly Rate (as listed on our website and you will receive a refund for the remaining amount of the Tutoring Package price.
In order to receive a refund per this policy, you must notify us of your desire to cancel your remaining sessions within 3 business days of attending your first tutoring session or at least 24 hours prior to your second tutoring session, whichever is earlier. Cancellation and refund requests submitted after this timeframe will not be honored.
This offer applies to Private Tutoring only and does not apply to any of our other products or services. This offer shall not be construed to waive your obligation to pay for your first tutoring session in its entirety, regardless of whether you have attended the session in whole, in part or not at all.

Private Tutoring No-Show and Cancellation

If your tutor is unable to attend a Private Tutoring session, he/she may cancel/reschedule that session and will endeavor to give you at least 24 hours notice of cancellation, except where sudden illness or other emergency makes this not feasible.
